Tomislav Đorđević receives a summons for the first day of trial and the Appellate Court’s Decision dated 01/29/2014 about jurisdiction of the High Court in Belgrade. Tomislav Đorđević has requested from the Ministry of Justice, the High Judicial Council and the Appellate Court in Belgrade, to take disciplinary measures against persons in the High Court in Belgrade responsible for withholding his appeal against detention instead of sending it to the Appellate Court, and those responsible for covering up that fact for two years by giving false information.

Ribarsko gazdinstvo. DTD Ribarstvo receives the ruling of the Commercial Court which denies the request initiated by the state custodian of Ribarsko gazdinstvo. The court rules that Ribarsko gazdinstvo suffered no damages in the business relationship with DTD Ribarstvo (another company of Tomislav Đorđević), as disputed transactions were carried out at fair market prices. The same supposed “damages” are still subject of the criminal proceeding against Tomislav Đorđević and others.

The Serbian Parliament has passed a new Law on Additions and Amendments to the Criminal Code. It remains unclear how the changes to articles 234 and 359, which come into effect on 15 April 2013, will be applied in practice.

The government has adopted a Draft Law on Amendments to the Criminal Code, under which company owners are meant to be removed from the circle of responsible persons who may abuse their positions in companies. However, amendment to Article 359 and 234 still leave ample room for judicial abuse, since it is unclear what kind of actions by responsible persons in companies may be incriminated under Article 234.

This proposal creates a new tool for arbitrary and unfounded criminal prosecution of owners and employees of private companies in Article 234 - Abuse of position of responsible person, replacing the provisions for company owners and management currently found in Article 359 - Abuse of office.

Court appointed experts in a commerical dispute launched by Ribarsko Gazdinstvo submitted their report on 01/12/2012. The experts value the assets sold by Ribarsko gazdinstvo to DTD Ribarstvo at RSD 82 million using the liquidation method and RSD 149 million using the income method. Both of these valuations are lower than the price paid for the assets by DTD Ribarstvo. Based on false “market values” provided by the Ribarsko Gazdinstvo “committee”, Tomislav et all are criminally charged with the sale of these same assets to DTD Ribarstvo below market value and alleged damages in excess of RSD 124 million (around EUR 1.4 million).
